1. About These Terms
Welcome to The Songwriters Path. This website and its associated services are owned and operated by Shelley Harland, trading as Tiger & Bear (ABN 82031649387) ("we", "us", "our"), based in New South Wales, Australia.
By accessing or using this website, purchasing our courses or products, joining our community, or engaging our services, you ("you", "your", "member") agree to be bound by these Terms & Conditions. If you do not agree, please do not use this website or our services.
These Terms apply to all offerings under The Songwriters Path, including the Inner Verse course, The Songwriters Path community, mentorship services, digital products, newsletters, workshops, and retreats.
2. Who Can Use Our Services
You must be at least 18 years old to purchase our courses or services. If you are under 18, you may only use our services with the consent and supervision of a parent or guardian, who agrees to be bound by these Terms on your behalf.
By using our services, you confirm that the information you provide to us is accurate and that you are legally able to enter into a binding agreement.
3. Our Services
The Songwriters Path provides songwriting education, creative development resources, community membership, and mentorship, including:

Inner Verse — a 30-day online songwriting course

The Songwriters Path community — a membership community hosted on Skool

Mentorship — one-on-one or group mentoring sessions

Newsletters and free content — including the Inner Verse newsletter

Retreats, workshops, and live events (subject to additional terms provided at booking)
We may add, modify, or discontinue services at any time. If a change materially affects a paid service you have already purchased, we will notify you and, where required by law, offer an appropriate remedy.
4. Third-Party Platforms
Some of our services are delivered through third-party platforms, including Skool (community and course hosting), Substack (newsletter), Zoom (live sessions), and payment processors such as Stripe or PayPal.
Your use of those platforms is also governed by their own terms of service and privacy policies. We are not responsible for the acts, omissions, availability, or security of third-party platforms, though we will do our best to assist you if issues arise.
5. Accounts and Membership
When you join our community or purchase a course, you may need to create an account (including on Skool). You are responsible for:

Keeping your login details secure and confidential

All activity that occurs under your account

Notifying us promptly of any unauthorised use
Accounts and memberships are personal to you. You must not share, sell, or transfer your account or access credentials to anyone else.
6. Payments, Pricing, and Subscriptions
All prices are displayed in US Dollars (USD) and, where applicable, include GST.
One-time purchases (such as courses or digital products) grant you access as described at the point of sale.
Subscriptions (such as community membership) renew automatically at the stated interval until cancelled. You may cancel at any time through your Skool account settings or by contacting us; cancellation takes effect at the end of the current billing period, and no partial refunds are provided for unused time in that period, except as required by law.
We may change our prices at any time. Price changes to subscriptions will apply from your next billing cycle, and we will give you reasonable notice before any increase.
If a payment fails or is reversed, we may suspend your access until payment is resolved.
7. Refunds and Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you have under the Australian Consumer Law (ACL) or other applicable laws that cannot lawfully be excluded.
If our services fail to meet a consumer guarantee under the ACL, you are entitled to a remedy — such as a refund, replacement, or re-supply — depending on whether the failure is major or minor.
Change of mind: Beyond your legal rights, we do not generally offer refunds for change of mind on digital products and courses once access has been granted, because the content is immediately accessible and cannot be "returned."
Retreats and live events: Deposits and cancellation terms for retreats and in-person events are set out at the time of booking and may differ from the above due to venue and supplier commitments.

8. Intellectual Property
All content on this website and within our courses, community, newsletters, and materials — including but not limited to text, videos, audio, music, lesson materials, the Inner Verse methodology and its six elements, the Daily 6 practice, the 6S (Six Sense) songwriting framework, Song Cards, the Song Map, workbooks, branding, and logos — is owned by or licensed to us and is protected by copyright, trade mark, and other intellectual property laws.
When you purchase a course or membership, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use the materials for your own personal, non-commercial creative development.
You must not:

Copy, reproduce, distribute, republish, or publicly display our materials

Share course content, downloads, or community content with non-members

Sell, licence, or commercially exploit our materials, frameworks, or methodology

Use our materials to create competing courses, products, or teaching programs

Remove any copyright or proprietary notices
This licence ends if your membership ends or if you breach these Terms.
9. Your Songs and Creative Work
You own your songs. Any songs, lyrics, melodies, demos, or other creative work you create during or as a result of our courses, community, or mentorship remain 100% your intellectual property. We claim no ownership, royalty, or interest in your creative work.
When you share your work within the community (for example, in "A Body of Work"), you grant us and other members a limited licence to view and discuss it within the community for feedback purposes only. Other members are not permitted to copy, use, or exploit your shared work, and you must extend the same respect to theirs.
If we would ever like to feature your work publicly (for example, as a testimonial or success story), we will ask for your express permission first.
10. Community Guidelines and Conduct
Our community is built on creative courage, generosity, and mutual respect. By participating, you agree to:

Treat all members with respect and kindness

Give feedback that is constructive and supportive

Keep other members' shared work and personal disclosures confidential

Not harass, bully, discriminate against, or abuse any member

Not post content that is unlawful, defamatory, obscene, hateful, or infringes anyone's rights

Not spam, advertise, or solicit members without our permission

Not record, screenshot, or share community discussions or live sessions outside the community
We may moderate, edit, or remove content at our discretion, and may suspend or terminate membership (without refund, except as required by law) for serious or repeated breaches of these guidelines.
11. User Content
If you post content in our community or on our platforms (comments, posts, questions, feedback), you grant us a non-exclusive, royalty-free, worldwide licence to host, display, and reproduce that content for the purpose of operating and promoting the community. This does not apply to your songs and creative work, which are covered by clause 9.
You are responsible for the content you post and warrant that it does not infringe any third-party rights.
12. No Guarantees of Outcomes
Our courses, community, and mentorship are educational and developmental in nature. While we share proven creative frameworks drawn from 25+ years of professional songwriting experience, we make no guarantees about:

The commercial success of any songs you write

Record deals, sync placements, streams, or industry outcomes

Income or career results of any kind
Any examples of Shelley's career or other members' results are illustrative only and are not a promise of similar outcomes. Your results depend on many factors, including your own effort, circumstances, and factors outside anyone's control.
13. Not Professional Advice
Our content may touch on wellbeing, personal growth, intuition, and creative practices. This content is offered for educational and inspirational purposes only and is not medical, psychological, therapeutic, legal, financial, or other professional advice. If you have concerns about your mental or physical health, please consult a qualified professional.
Nothing in our courses or community creates a therapist–client, counsellor–client, or other professional relationship.
14. Website Use
You must not:

Use this website for any unlawful purpose

Attempt to gain unauthorised access to our systems or other users' accounts

Introduce viruses, malware, or other harmful code

Scrape, harvest, or collect data from the website, including using automated tools or AI systems to extract our content

Interfere with the proper operation of the website
We do not guarantee the website will be available at all times, error-free, or free of viruses. We may suspend or withdraw the website for maintenance or other reasons without notice.
15. Links to Other Websites
Our website and content may contain links to third-party websites. These links are provided for convenience only. We do not endorse, and are not responsible for, the content or practices of third-party websites.
16. Limitation of Liability
To the maximum extent permitted by law, and subject always to your non-excludable rights under the Australian Consumer Law:

We exclude all liability for any indirect, incidental, special, or consequential loss or damage, loss of profits, loss of data, or loss of opportunity arising from your use of the website or our services.

Where our liability cannot be excluded but can be limited, our liability is limited to, at our option: re-supplying the services to you, or paying you the cost of having the services re-supplied.

Our total aggregate liability to you in connection with these Terms is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.
Nothing in this clause excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence.
17. Indemnity
You agree to indemnify us against any loss, damage, cost, or expense (including reasonable legal fees) we suffer arising from your breach of these Terms, your violation of any law or third-party rights, or content you post through our platforms — except to the extent caused by our own negligence or breach.
18. Termination
We may suspend or terminate your access to our services if you breach these Terms, engage in conduct harmful to our community or other members, or fail to pay amounts owing.
You may end your membership at any time by cancelling your subscription. Clauses relating to intellectual property, limitation of liability, indemnity, and any accrued rights survive termination.
19. Privacy
We collect and handle personal information in accordance with our Privacy Policy, available at https://www.thesongwriterspath.com/privacy-policy. By using our services, you consent to that collection and handling.
20. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Material changes affecting existing paid services will be notified to you by email or through the community. Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.
21. General

Governing law: These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.

Severability: If any provision of these Terms is found invalid or unenforceable, it will be severed and the remaining provisions will continue in full force.

No waiver: Our failure to enforce any right under these Terms is not a waiver of that right.

Entire agreement: These Terms, together with our Privacy Policy and any terms presented at the point of purchase (e.g. retreat booking terms), form the entire agreement between us regarding your use of our services.
